Rule 9 of the Florida Rules of Procedure governs the appeal process.
- Circuit Courts review by appeal the orders of lower tribunals, otherwise known as County Courts.
- District Courts of Appeal review by appeal:
- Final orders of trial courts not directly reviewable by the Supreme Court or a Circuit Court
- Non-final orders of Circuit Courts
- The Supreme Court reviews by appeal final orders of courts imposing death sentences and decisions of the state
courts that declare invalid any statutes or provisions of the state constitution.
Requirements to File an Appeal
Appeals should be filed within thirty (30) days of rendition of the order to be reviewed.
For Probate and Circuit Civil cases it is necessary to file:
- Original Notice of Appeal
- Conformed copy of the order being appealed
- Filing fee
For Felony, Misdemeanor and Traffic cases it is necessary to file:
- Notice of Appeal
- Filing fee
For Juvenile Dependency cases it is necessary to file:
- Original Notice of Appeal
- Conformed copy of the order being appealed
- No Filing Fee Required
For Juvenile Delinquency cases it is necessary to file:
- Original Notice of Appeal
- No Filing Fee Required

Filing Fees
Felony, Probate and Circuit Civil - $100.00 (Clerk’s filing fee)
2nd District Court of Appeals - $300.00
(in addition to & must accompany the Clerk’s $100 filing fee)
County Civil, Misdemeanor or Traffic - $281.00
There is no charge for filing an appeal in a Juvenile case.

Payment for Fees and Costs
- Payment for Clerk’s filing fees or other services may be submitted in cash, personal in state check with
proper identification, in state business check, money order, bank check, Visa or
Master Card. All payments for fees and costs must be
remitted in US currency.
DO NOT SEND CASH THROUGH THE MAIL.
Checks for Clerk’s filing fees must be made payable to:

If you are unable to pay the filing fee you must come to the Clerk's Office
to complete an Affidavit for Indigent Status and Deferral of Payment for Due Process
Services and a payment contract.
