General Civil Filing Fees
General Civil cases are actions that have been filed by an individual
or a business, against another person or business, for damages in excess of $5,000.
County Court has jurisdiction in cases up to $15,000.
Circuit Court has jurisdiction in cases greater than $15,000.
Some examples of civil cases include, but are not limited to the following:
- breach of contract
- monies due
- auto negligence
- foreclosure
- malpractice
- product liability
- miscellaneous writs
(possession, replevin,garnishment), etc.
The Florida Rules of Civil Procedure, Florida Statutes, Local Rules of Court, Administrative
Orders and other local judicial requirements govern civil actions. For these types of actions,
it is recommended that you contact a local attorney to file and process your case for you.
However, you do have the right to represent yourself, and if you choose to do so, you must be
responsible for knowing and following all legal requirements and procedures. Otherwise, your
case may be delayed or dismissed by the Court if all matters are not completed appropriately.
Clerk Assistance
The Clerk of the Circuit Court is prohibited by law from
providing legal advice or interpretation of laws or other court requirements, and
cannot advise you of the type of action to file, nor can we advise you of any probable
outcome of the case. Our departmental staff is able to provide you with the
following information:
- Schedule of fees and costs
- Issuance of summons and subpoenas
- Automated court records system and physical case files for your retrieval of information
- Assigning case numbers and processing of new cases and miscellaneous documents presented
for filing
- Issuance of writs
- Certifications and copies of documents filed for record
- Referral information (phone numbers and addresses)

Requirements to File a Case
- You must be at least 18 years old
- A minor child must have a parent or legal guardian file on their behalf
- You may be an individual, a person Doing Business As (DBA),
or a corporation
- Generally, your case must be filed in the County where the contract or other action
occurred, or where one or more of the defendants being sued lives. This same location
determines whether the case is assigned to either the East or West side of the county
- You must bring your original petition, along with enough copies for each person being sued,
plus copies for the sheriff to provide return of service

General Circuit Civil - $300.00
General County Civil - $300.00
Garnishment, Replevin, Attachment & Distress Writs, in addition to the above filing fee - $85.00

Service Costs
In accordance with applicable Florida Law, you have the following options to effect service of your court
papers:
- Summons to Sheriff - Clerk to issue $10.00 or
Clerk to prepare & issue $17.00
- Sheriff service $20.00 per defendant (State of Florida)
- Constructive Service - publication in newspaper, rates vary depending upon newspaper selected
- Constructive Service - publication by posting indigent cases only

Payment for Services
Mailing costs are payable to the Clerk of Circuit Court and may be included with the filing fee.
Costs for service by Sheriff service must be paid with a separate check, remitted at the time of
filing, along with check to Clerk for preparing or issuing summons.

Payment for Fees and Costs
- Payment for Clerk’s filing fees or other services may be submitted in cash, personal in
state check with proper identification, in state business check, money order, bank check,
Visa or Master Card. All payments for fees and costs must be remitted in US currency.
DO NOT SEND CASH THROUGH THE MAIL.
Checks for filing fees must be made payable to:

- Checks for Sheriff’s service must be made payable to:
Pasco County Sheriff OR to the Sheriff of the County where the defendant(s)
is (are) to be served. Some Sheriff’s Offices will not accept a personal check. You should
contact the appropriate county prior to filing your case.
DO NOT BRING CASH FOR THE SHERIFF.
