[ARCHIVED] ALERT: NEW RULES FOR OFFICIAL DOCUMENT RECORDING TAKE EFFECT JANUARY 1, 2024

New Port Richey, FL - To put the brakes on real property fraud The Pasco County Clerk’s Office will be implementing new requirements based on an amendment to Florida Statute 695.26 for recording instruments affecting real property.

What (in layman’s terms) does that mean to you? 

 Effective January 1, 2024, the Clerk will not record a document by which title to real property or interest is conveyed, assigned, encumbered, or disposed of unless:

  • The name of each witness is legibly printed, typewritten, or stamped immediately beneath the signature
  • The address of each witness is legibly printed, typewritten, or stamped on each instrument

What types of documents are we referring to including but not limited to, the following document types:

  • Deeds
  • Easements
  • Agreement for Deeds

Section 695.26 requires the Clerk to reject documents that do not include the witness address information.
