Requirements to File a Case

  • A minor child must have a parent or legal guardian file on his/her behalf
  • You may be an individual, a person Doing Business As (DBA), or a corporation
  • You must be at least 18 years of age

Generally, a small claims case must be filed in the county where the contract was entered into, property to be recovered is located, action occurred, or where one or more of the persons being sued reside(s).

Forms & Documents Needed to File Case

Forms and documents necessary to complete or provide to file a small claim include:

  • Contracts
  • Invoices
  • Law enforcement reports
  • Photographs
  • Promissory notes
  • Receipts
  • Statement of Claim (provided by the Clerk & Comptroller)

Copies of all documents filed to open a case must be provided to each defendant. Original documents are maintained in the court file. The Adobe Acrobat Reader (version 4.0 or higher is recommended) will allow you to complete the form online and print it; however you will not be able to save it.
